BIIA reported in a recent post that Europatent had entered insolvency proceedings. Today BIIA received a press release from Europatent’s insolvency administrator Mirko Möllen of PLUTA Rechtsanwalts GmbH, who has ensured that business operations at the insolvent company EUROPATENT Gesellschaft für europäischen Patentdienst GmbH + Co. OHG will continue. “Business is good, the customers have stayed loyal to us,” said Möllen. The company is continuing to execute orders and is taking on new orders.
The Local Court of Weilheim appointed the restructuring expert Mirko Möllen as the insolvency administrator of EUROPATENT with an order issued on 1 August 2014. The Court had previously ordered preliminary insolvency administration on 26 May.
EUROPATENT has been an expert in the area of commercial legal protection for 60 years. The many years of experience ensured services of the highest quality. Large numbers of customers in the industrial and legal sectors benefited from EUROPATENT’s high level of expertise. The company based in Berg on Lake Starnberg, Germany, currently has a staff of 16 full-time and part-time employees. The managing director, Günther Gottschalk, has continued at the helm and is making a key contribution to the successful continuation of business operations.
Reports that the company’s situation had deteriorated are simply not true. The liquidation of the company was entered in the commercial register. This is a legal process pursuant to the rule that applies when insolvency proceedings are initiated against companies that have been entered in the commercial register. The continuation of business operations is not affected by this and the company’s full ability to act is guaranteed.
If business continues to run positively, Möllen believes that insolvency plan proceedings will be possible in the medium term. Insolvency plan proceedings involve an agreement being reached between the insolvent company and its creditors. If the insolvency plan is accepted by the creditors, the court decides whether to confirm the plan. Subsequently, the insolvency proceedings are terminated.
